RIGHTS AND RESPONSIBILITIES OF THE MOVEVN.COM WEBSITE MANAGEMENT

RIGHTS OF THE MANAGEMENT:

• The management has the right to establish, operate, and manage the website to provide studio-related services.
• The management may issue operational regulations and define the rights and obligations of all parties participating on the platform.
• The management may refuse service or suspend accounts of partners/customers who violate the terms of use.
• The management may inspect and monitor content and transaction information on the website to ensure compliance with applicable laws.
• The management may implement promotional programs in accordance with legal regulations

RESPONSIBILITIES OF THE MANAGEMENT

• The management is responsible for ensuring the stable operation of the website/application and protecting users’ personal data in compliance with applicable laws.
• The management is responsible for providing accurate information regarding gym services, pricing, and cancellation/refund policies.

RIGHTS AND RESPONSIBILITIES OF CUSTOMERS

CUSTOMER RIGHTS:

• Customers have the right to access detailed information about training packages, coaching services, and promotional programs available on the platform.
• Customers may select and purchase services according to their personal needs.
• Customers may request support from the management in case of issues or disputes.
• Customers may file complaints and request compensation if services are not provided as committed.
• Customers’ legitimate rights are protected in accordance with applicable laws.

CUSTOMER RESPONSIBILITIES:

• Customers are responsible for carefully reading the terms of use and refund/cancellation policies before making a purchase.
• Customers must provide accurate information when registering an account and making payments.
• Customers must comply with gym rules and regulations and must not disrupt or negatively affect the activities of other members.
• Customers must refrain from fraudulent activities, unreasonable refund requests, or violations of the platform’s regulations.

REFUNDABLE POLICY & TRANSFERABILITY (APPLY TO ALL PACKAGES, INCLUDING PT)

• All packages and memberships are non-refundable and non-transferable. Unless otherwise expressly stated in this document or required by applicable law, all payments are non-refundable. 
• Reselling, transferring, or otherwise disposing of your class package or membership without MOVE’s prior written authorisation is strictly prohibited. Any such violation may result in the immediate suspension or termination of your package, without prior notice. MOVE reserves the right to take any other legal actions as permitted under applicable law.
• This policy applies to all products sold on MOVE’s website or application, including class packages and memberships.

PRICE CHANGES

• The studio reserves the right to adjust pricing at any time.
• Clearly state whether existing memberships are entitled to retain their current pricing or not.

FAILED OR LATE PAYMENTS

• Booking privileges may be suspended until outstanding payments are settled.

AGREEMENT CLAUSE: By purchasing any class, package, or membership, you agree to our Payment Policy.

TERM & TERMINATION

These Terms and Conditions remain effective from the date of purchase, booking, or participation in any service provided by the studio. The studio reserves the right to suspend or terminate access to its services, memberships, or bookings at any time in cases of violation of these Terms, inappropriate conduct, or misuse of studio facilities. Any termination does not entitle the participant to a refund for unused classes, packages, or memberships, unless otherwise required by law.

ELIGIBILITY, REGISTRATION & ACCOUNT SECURITY

• The Site is intended for use in Vietnam only and is not available to users who have been suspended or removed by MOVE.
• If an account is created or used on behalf of a company or organisation, the customer confirms authorisation to represent and bind that organisation to these Terms.
• Customers must provide accurate and up-to-date registration information and keep it current at all times.
• Customers are responsible for maintaining the confidentiality of their account and password and for all activities conducted under their account.

PROHIBITED CLUB CONDUCT

BY USING THE SITE, YOU PROMISE TO:

• Respect the facility
• Respect the procedures
• Respect the teams
• Respect other customers
• Respect the products

PROHIBITED CONDUCT

WHEN USING THE SITE, YOU AGREE NOT TO:

• Customers must not harass, threaten, defraud, or spam other users.
• Customers must not send unauthorised advertisements or solicitations.
• Customers must not impersonate others or access another user’s account without permission.
• Customers must not share MOVE-issued passwords or allow others to use their account or booked classes.
• Customers must not misrepresent information or remove copyright or ownership notices.
• Customers must not upload viruses or harmful content.
• Customers must not upload or share content they do not have the legal right to use.
• Customers must not upload or send pornographic, hateful, abusive, defamatory, or otherwise inappropriate content.

PROHIBITED SITE USES

• Customers access the Site at their own responsibility and must comply with all applicable laws.
• Customers may not use the Site for any unlawful purpose or in violation of these Terms.
• Customers may not damage, disrupt, overload, or interfere with the Site or other users’ access, attempt unauthorised access, bypass security features, or obtain content through unauthorised means.
• Customers may not modify the Site, use modified versions, or use automated tools (including bots, scrapers, or spiders) without MOVE’s written permission.
• Customers must be at least 18 years old to use the Site or purchase MOVE packages.

OWNERSHIP & PROPRIETARY RIGHTS

• The Site is owned and operated by MOVE Company Limited. All content on the Site, including designs, graphics, software, information, and services (“Materials”), is protected by applicable intellectual property laws.
• Except for content you upload, all Materials are the property of MOVE or its affiliates and/or licensors. All trademarks and trade names used on the Site belong to MOVE or their respective owners.
• Unless expressly authorised by MOVE, you may not copy, distribute, modify, display, publish, create derivative works from, or otherwise use the Materials without permission.

WAIVER

• Any waiver of these Terms must be made in writing by the party entitled to enforce it. Failure to enforce any provision at any time does not waive the right to enforce it later.
• A waiver of one breach does not constitute a waiver of any other or future breaches.

DISPUTE RESOLUTION

• If a dispute arises, customers are encouraged to contact MOVE first to seek a resolution.
• Customers and MOVE may resolve disputes through mediation, arbitration, or other agreed-upon methods before pursuing litigation.
• These Terms are governed by the laws of Vietnam, and any legal claims must be brought in Vietnamese courts. Customers agree to the jurisdiction of courts in Vietnam for any disputes.
